Pennsylvania Enforces Vape Directory on Oct. 19: Off-List Products Face Seizure

Pennsylvania authorities will begin retail enforcement of Act 57 on October 19, banning the sale of any nicotine vapor product not listed on the state’s official directory. The transition period has ended, giving the Attorney General direct authority to seize off-directory inventory and penalize non-compliant retailers.

Dual Approval: Linking State Directory to FDA Status

Act 57 creates a state-level regulatory filter. Manufacturers must submit product details and pay certification fees to the Pennsylvania Attorney General to secure listing on the Electronic Nicotine Delivery System (ENDS) directory. Products must also satisfy federal Food and Drug Administration (FDA) conditions, including Premarket Tobacco Product Application (PMTA) requirements.

Attorney General Dave Sunday stated that the policy targets youth access directly: "When it comes to vapes and e-cigarettes, these products are often marketed to attract children. Act 57 puts into place a directory of vape and e-cigarette products that are permissible for sale in Pennsylvania."

Daily Fines and Business License Suspensions

Selling, offering, or stocking an unlisted nicotine product carries financial and administrative penalties under the new enforcement rules.

Violation LevelFinancial PenaltyAdministrative Action
First Violation$500 per unlisted productProduct removal notice
Second Violation (within 12 mos.)$750 – $1,000 per product / dayMinimum 14-day license suspension

Vape Shop Owners Brace for Shelf Clearances

Retailers across the state are auditing their stock. James Wyckoff, manager at Mountain Vaporz in Tannersville, expressed concern over how the restrictions affect adult consumers transitioning away from combustible cigarettes.

"Our customers depend on these things; they don't wanna go back to smoking cigarettes, they're happy," Wyckoff said. "They want their flavors; they want their equipment, and the state doesn't seem to realize or care. While I agree that vapes do not belong in the hands of our youths, we card people all the time."

The disposable vape category faces the heaviest disruption due to the wide variety of flavors and device styles requiring individual certification. Because the state updates the directory at least monthly, retailers must maintain ongoing documentation checks with licensed wholesalers to remain compliant.
